Terms of Service for ARC

Agreement to Terms
By accessing or using ARC, you agree to these Terms of Service. If you don't agree, don't use ARC.
Description of Service
ARC is a mobile application that provides narrative intelligence through journaling, conversation, and reflection. The service includes:
- Personal journaling with AI-powered insights
- Phase detection across six developmental states
- Narrative memory and pattern recognition
- Voice journaling capabilities
- Cross-device synchronization (optional)
ARC is powered by LUMARA, our narrative intelligence engine.
Eligibility
You must be at least 13 years old to use ARC. If you're under 18, you represent that you have parental consent.
Account Registration
Creating an Account
- You must provide accurate, current information
- You're responsible for maintaining account security
- You may not share your account credentials
- Notify us immediately of any unauthorized access
Account Termination
- You may delete your account at any time in Settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your data will be deleted per our Privacy Policy
Acceptable Use
You May
- Use ARC for personal journaling and reflection
- Create multiple journal entries and conversations
- Export your own data
- Use voice features for personal journaling
You May Not
- Use ARC for any illegal purpose
- Attempt to reverse engineer or hack the service
- Share content that's abusive, threatening, or harassing
- Impersonate others or create fake accounts
- Use automated systems (bots) to access ARC
- Attempt to access other users' data
Subscription and Payment
Pricing
- Monthly: $30/month
- Annual: $200/year (save $160)
- Prices subject to change with 30 days notice
Billing
- Subscriptions auto-renew unless cancelled
- You're charged at the start of each billing period
- All payments processed securely via Stripe
- We don't store your credit card information
Cancellation and Refunds
- Cancel anytime in your account settings or through the App Store/Google Play
- Cancellation takes effect at the end of the current billing period
- No refunds for partial periods or unused time
- Trial Period: If offered, cancel before trial ends to avoid charges
Changes to Pricing
- We may change subscription prices with 30 days notice
- Price changes don't affect your current billing period
- Continued use after price change constitutes acceptance
Intellectual Property
Our Rights
- ARC, LUMARA, and all related content are owned by Orbital AI, Inc.
- Our code, algorithms, and design are protected by copyright and trade secret law
- You may not copy, modify, or create derivative works
Your Rights
- You own your journal content
- You grant us a limited license to process your content to provide the service
- We don't claim ownership of your entries
- You can export and delete your content anytime
Service Availability
No Guarantees
- We strive for 99.9% uptime but don't guarantee it
- Maintenance windows may temporarily interrupt service
- Features may be added, changed, or removed
Updates
- We may release updates to improve ARC
- Some updates may be required for continued use
- We're not obligated to maintain backward compatibility
Disclaimers and Limitations
Not Medical or Mental Health Services
- ARC IS NOT THERAPY and does not replace professional mental health care
- We don't diagnose, treat, or prevent any medical or mental health condition
- Our phase detection describes developmental patterns, not clinical conditions
- If you're in crisis, contact a mental health professional or emergency services
"As-Is" Service
- ARC is provided "as-is" without warranties of any kind
- We don't guarantee accuracy, reliability, or fitness for any purpose
- Use at your own risk
Limitation of Liability
To the maximum extent permitted by law, Orbital AI, Inc. is not liable for:
- Indirect, incidental, or consequential damages
- Lost profits, data, or opportunities
- Damages exceeding the amount you paid in the last 12 months
Exceptions
- Some jurisdictions don't allow these limitations
- These limitations don't apply where prohibited by law
Indemnification
You agree to indemnify and hold harmless Orbital AI, Inc. from claims arising from:
- Your violation of these Terms
- Your violation of any law or rights of others
- Your use of ARC
Privacy
Your use of ARC is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.
Arbitration
- Disputes will be resolved through binding arbitration (not court)
- Arbitration conducted by JAMS under its Streamlined Arbitration Rules
- Exception: Either party may seek injunctive relief in court
Class Action Waiver
- You agree to resolve disputes individually, not as part of a class action
- No class arbitrations or consolidated proceedings
General Terms
Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Orbital AI, Inc.
Modifications
- We may modify these Terms at any time
- Material changes will be notified via email or in-app
- Continued use after changes constitutes acceptance
Severability
If any provision is found unenforceable, the rest of these Terms remain in effect.
No Waiver
Our failure to enforce any right doesn't waive that right.
Assignment
You may not transfer your rights under these Terms. We may assign our rights to any successor entity.
